29 CFR 1926.55(a): Employee(s) were exposed to material(s) at concentrations above those specified in the Threshold Limit Values of Airborne Contaminants for 1970 of the American Conference of Governmental Industrial Hygienists: (a) At the Huntley Ditch Project: On or about 29 April 2013 and at times prior during shotcrete application in the tunnel, one of the employees was exposed to respirable silica at a concentration greater than the 8 hour Time Weighted Average (TWA) Permissible Exposure Level (PEL) of 37.88 million particles per cubic foot (mppcf). The employee was exposed to respirable silica at a concentration of 64.31 mppcf as an 8 hour TWA. This is 1.70 times the PEL. Air monitoring was conducted for 100 minutes.

29 CFR 1910.134(c)(1): This provision is applicable to construction employment as per 1926.103: A written respiratory protection program that included the provisions in 29 CFR 1910.134(c)(1)(i) - (ix) with worksite specific procedures was not established and implemented for required respirator use: (a) Huntley ditch Project: On or about 29 April 2013 and at times prior thereto, when the employer required employees to wear a respirator such as but not limited to a 3M 6200 half-face respirator with HEPA filters, the employer did not ensure employees were provided with and/or implement an effective written respirator program that included the following provisions: a) The employees had not been medically evaluated to wear a respirator. b) The employees had not been yearly fit tested on the tight fitting respirators. c) Correct procedures for storage and handling of respirators were not followed.
