29 CFR 1910.134(c)(1): A written respiratory protection program that included the provisions in 29 CFR 1910.134(c)(1)(i) - (ix) with worksite specific procedures was not established and implemented for required respirator use: (Construction Reference 1926.103): a) Oxford Mills - Employees were required to wear half-mask air purifying respirators when they used HEPA vacuums to clean the dust on floors and surfaces in the East and West Buildings. The employer did not establish and implement a written respiratory protection program as referenced in 1926.103, exposing employees to lead. Wipe samples of the floor and other surfaces in the East and West Buildings were taken on 4/5/13, 4/8/13, 5/13/13, and 7/10/13 and contained between 317 to 3829 micrograms of lead per 100 square centimeters. Note: Abatement certification required within 10 days after abatement date. The certification shall include a statement that abatement is complete, date and method of abatement, and states employees and their representatives were informed of this abatement.

29 CFR 1910.134(c)(2)(ii): The employer did not establish and implement those elements of a written program necessary to ensure that any employee using a respirator voluntarily was medically able to use that respirator, and that the respirator was cleaned, stored, and maintained so that its use does not present a health hazard to the user (Construction Reference 1926.103): a) Oxford Mills - Employees wore half-mask respirators voluntarily and the employer did not ensure that employees were medically able to wear a respirator, as referenced in 29 CFR 1926.103. Observed on or about 4/26/13. b) Oxford Mills - Employees wore half-mask air purifying respirators voluntarily, and the respirators were not cleaned and maintained in a sanitary condition, exposing employees to lead, as referenced in 29 CFR 1926.103. Wipe samples taken on the inside of respirators worn by two employees contained lead. Observed on or about 4/26/13. Note: Abatement certification required within 10 days after abatement date. The certification shall include a statement that abatement is complete, date and method of abatement, and states employees and their representatives were informed of this abatement.
