29 CFR 1926.602(c)(1)(ii): Modifications or additions which affect the capacity or safe operation of the equipment were made without the manufacturer's written approval: On April 26, 2013, employees were using an addition (job made wooden box) on an all-terrain forklift to work at an elevated level, that was not approved by the manufacture. This condition exposed employees to fall up to 15 feet to the ground.

29 CFR 1910.178(l)(3)(i)(M): Powered industrial truck operators shall receive initial training in the following topics to include but not limited to operating instructions, warnings, or precautions listed in the operators manual for the types of vehicle that the employee is being trained to operate: 1926.602(d): Powered industrial truck operator training. Note: The requirements applicable to construction work under this paragraph are identical to those set forth at �1910.178(l) of this chapter. On April 26, 2013, employees did not receive initial training which included warnings or precautions such as inappropriate lifting of personnel. This condition exposed employees to falls up to 15 feet to the ground.
