29 CFR 1910.215(a)(4): Work rest(s) on grinding machinery were not adjusted closely to the wheel with a maximum opening of one eighth inch:   a)  Maintenance/Carpentry Shop - Noted on or about 4/24/13 and at times prior thereto, a doubled wheeled Dayton bench grinder had a gap of 1.5" on the right side between the work rest and grinding wheel, and 1" on the left side between the work rest and the grinding wheel.

29 CFR 1910.215(b)(9): The distance between the abrasive wheel periphery(s) and the adjustable tongue or the end of the safety guard peripheral member at the top exceeded one fourth inch:    a)  Maintenance/Carpentry Shop - Noted on or about 4/24/13 and at times prior thereto, a Dayton bench grinder had two tongue guards that were not adjusted to within 1/4" of the grinding wheel; the gap on both the left and right hand wheels was 3/4".

29 CFR 1910.132(d)(2): The employer did not verify that the required workplace hazard assessment has been performed through a written certification which included the requirements as outlined in 29 CFR 1910.132(d)(2):  a) Maintenance/Engineering - Noted on or about 4/24/13 and at times prior thereto, the employer did not prepare a workplace hazard assessment for employees using chemicals, hand tools, and machinery that require the use of personal protective equipment (PPE).  The employer has provided PPE such as safety glasses, ear plugs, and hardhats. A hazard assessment has not been conducted to include the following:  1.  Select and have each affected employee use the types of PPE that will protect them from the hazards identified in the hazard assessment;   2.  Communicate the selection decisions to each affected employee and;  3.  Select PPE that properly fits each affected employee.        *ABATEMENT NOTE:  The employer shall verify that the required workplace hazard assessment has been performed through a written certification that identifies the workplace evaluated; the person certifying that the evaluation has been performed; the date(s) of the hazard assessment; and, which identifies the document as a certification of hazard assessment.
