OSH ACT of 1970 Section (5)(a)(1): Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to fire hazards from enclosureless dust collectors that were not maintained to contain combustible wood dust:    a)  The front room enclosureless dust collector, located in an outdoor shed/room connected to the main production building, was not maintained to ensure the capture of combustible wood dust.  The system was being operated without filters/collection bags resulting in excessive and constant dust loading inside of the structure during operation.

29 CFR 1910.22(a)(1): All places of employment, passageways, storerooms or service rooms were not kept clean and orderly or in a sanitary condition.    a)  The employer did not ensure that combustible wood dust (kst 33.96 bm/s) was cleaned off the walls and wall wood wall supports behind the sander and other areas of the inside of the building on a regular and routine basis.    b)  The employer did not ensure that area where the wood miser was located including the perimeter of the building was kept clear and clean from combustible materials, inculding but not limited to, wood scraps and wood dust that could post a fire hazard.

29 CFR 1910.95(c)(1): The employer did not administer a continuing, effective hearing conservation program as described in 29 CFR 1910.9(c) through (o) whenever employee noise exposures equal or exceed an 8-hour time-weighted average sound level of 85 decibels measured on the A scale, or equivalently a dose of fifty percent:    a)  The employer did not institute a hearing conservation program for employees working the chop saws who were exposed to sound levels of 87.3 dBA and 88.1 dBA for an 8-hour time weighted average.
