OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to being crushed and or struck by a falling load.    A)  In the shop, on or about April 30, 2013, and at times prior to, employees operated 7.5 ton overhead Crane with electric hoist to lift steel plates and other materials.  The hook used with the hoist did not have a self-closing spring operated latch across the throat of the hook to prevent materials from accidentally becoming detached from the hook, exposing employees to struck-by falling materials.       B)  In the shop, on or about April 30, 2013, and at times prior to, employees operated 5 ton overhead Crane with electric hoist to lift steel plates and other materials.  The hook used with the hoist did not have a self-closing spring operated latch across the throat of the hook to prevent materials from accidentally becoming detached from the hook, exposing employees to struck-by falling materials.       FEASIBLE ABATEMENT METHOD: Have employees inspect the hook to assure that a latch is in place and functioning.       ABATEMENT CERTIFICATION AND DOCUMENTATION ARE REQUIRED.

29 CFR 1910.157(c)(1): The employer shall provide portable fire extinguishers and shall mount, locate and identify them so that they are readily accessible to employees without subjecting the employees to possible injury.     A)  In the shop, on or about April 30, 2013, and at times prior to, fire extinguisher was blocked with boxes, table and other materials at the plasma area, exposing employees to fire hazards in case of an emergency situation.      B)  In the shop, on or about April 30, 2013, and at times prior to, the employer had a fire extinguisher sign on the big sliding door by the plasma area, without fire extinguisher, exposing employees to fire hazards in case of fire emergency.
