29 CFR 1910.119(j)(5): The employer did not correct deficiencies in equipment that were outside acceptable limits (defined by the process safety information on paragraph (d) of this section) in a safe and timely manner when necessary means where taken to assure safe operation. Work site located at 590 Road 9, Schuyler, NE: Rusted piping and damaged insulation in the engine room had not been addressed. Rusted piping located on the roof of the facility had also not been addressed to ensure that the integrity of the piping was maintained and the corrosion process retarded or prevented. Abatement certification and abatement documentation is required for this violation. The documentation should include written verification of abatement, applicable measurements or monitoring results, and photographs or videos which you believe will be helpful. 29 CFR 1910.119(n): The employer did not implement an emergency plan for the entire plant in accordance with the provisions of 29 CFR 1910.38: Work site located at 590 Road 9, Schuyler, NE; throughout the company: The employer has not developed exit routes for the employees to follow in the event of an evacuation and then provide training regarding those routes. The facility uses ammonia as part of their refrigeration system and a release could harm any employee that does not evacuate to a safe, predetermined area. The evacuation plan should include a method for determining the safe route and rally point utilizing a wind sock to determine the safe upwind predetermined evacuation location as well as employee training on the defined evacuation locations. Abatement certification and abatement documentation is required for this violation. The documentation should include written verification of abatement, applicable measurements or monitoring results, and photographs or videos which you believe will be helpful. The abatement certification sheet is enclosed with the citations.

29 CFR 1910.303(b)(1): Electrical equipment was not free from recognized hazards that were likely to cause death or serious physical harm to employees: Work site located at 590 Road 9, Schuyler, NE: The electrical installations listed below had recognizable hazards which had not been addressed. a) Grind Room: a conduit tree located on the floor near the #1D Henry machine had a conduit body where the cover was no longer tightly secured to the body. This allows water to enter the body (the fixture is designed for wet or damp locations when correctly installed) during normal and cleaning operations. b) Basement Area: An electrical switch box used to control the Splitsaw Air Compressor was corroded to the point where the mounting bracket was no longer supporting the box. Moisture had also penetrated the box based upon the corrosion observed in the inside of the installation. This box was designed for use in a wet/damp location and had corroded past the point of being safe for use. c) Grind Room North Wall: Four electrical boxes have damage to the cabinets and the shut off handles. One of the handles is damaged to the point where it cannot be safely utilized. The boxes were not installed with guards of sufficient strength to prevent the observed damage. Abatement certification is required for this violation. The abatement certification sheet is enclosed with the citations.
