29 CFR 1926.1053 (b)(1): When portable ladders were used for access to an upper landing surface, the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface to which the ladder is used to gain access: A. Frank Yavorski worksite located at 2127 Whitehall Dr., Ottawa Hills, Ohio: On or about April 29, 2013, the employer did not ensure the side rails of the extension ladder was extended at least three feet above the landing surface. The ladder was extended approximately 18 inches above the landing surface and not secured. Three employees were exposed to falls while using the ladder to access the roof.

29 CFR 1926.501(b)(10): Each employee engaged in roofing activities on low-slope roofs, with unprotected sides and edges 6 feet (1.8 m) or more above lower levels was not protected from falling by guardrail systems, safety net systems, personal fall arrest systems, or a combination of warning line system and guardrail system, warning line system and safety net system, or warning line system and personal fall arrest system, or warning line system and safety monitoring system: A. Frank Yavorski worksite located at 2127 Whitehall Dr., Ottawa Hills, Ohio: On or about April 29, 2013, the employer did not ensure employees were protected from falls while performing weatherproofing activities on the low sloped, two story residential structure. Employees were exposed to a fall distance of approximately 18.00 feet on the west side of the structure. Frank Yavorski was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1926.501 which was contained in OSHA inspection number 311608988, citation number 1, item number 1 and was affirmed as a final order on July 24, 2009, with respect to a workplace located at Maumee, Ohio.
