29 CFR 1910.146(d)(5)(i): Under the permit-required confined space program required by 29 CFR 1910.146(c)(4), the employer did not evaluate permit space conditions when entry operations were conducted by testing conditions in the permit space and when entry was authorized and by continuously monitoring those areas where authorized entrants were working: In the Ethylene Unit of Chevron Phillips Chemical Company facility, inside of quench settler vessel FA-123, employees were working near the bottom of the 21' diameter vessel, however air monitoring was only being conducted from the manway approximately 2/3 up from the bottom of the vessel using an approximate 4 foot length of hose. This condition exposed employees working near the bottom of the tank to unknown atmospheric conditions, which could potentially cause flash fires, when using non-intrinsically safe tools.

29 CFR 1910.307(c): Equipment, wiring methods, and installations of equipment in hazardous (classified) locations were not intrinsically safe, approved for the hazardous (classified) location, or safe for the hazardous (classified) location At the Chevron Phillips Chemical Company facility, in the ethylene unit, where the coke and liquids in Quench Settler Vessel FA-123 were being cleaned out, employees were using non-intrinsically safe tools and lighting in a Class 1 Division 2 Group C & D area. This condition exposed workers to potential fire and explosion hazards.

29 CFR 1910.305(g)(2)(iii): Flexible cords and cables shall be connected to devices and fittings so that strain relief is provided that will prevent pull from being directly transmitted to joints or terminal screws: In the Ethylene Unit of the Chevron Phillips Chemical Company facility, on the ground in front of quench settler vessel FA-123, there was a yellow extension cord which had been in use with the insulation pulled back exposing wires below exposing workers in this elevated Volatile Organic Compound (VOC) area to potential fire and explosion hazards.
