29 CFR 1910.178(l)(4)(iii): An evaluation of each powered industrial truck operator's performance was not being conducted at least once every three years: At the back side of the structure on May 6, 2013, the employee operating the Komatsu 20 Forklift, license number 206 SEQ, was not evaluated at least once every three years. The employee used the forklift in conjunction with a man basket to raise and lower personnel to and from the roof.

29 CFR 1926.501(b)(10): Each employee engaged in roofing activities on low-slope roofs with unprotected sides and edges 6 feet or more above lower levels, was not protected from falling by guardrail systems, safety net systems, personal fall arrest systems, or a combination of warning line system and guardrail system, warning line system and safety net system, or warning line system and personal fall arrest system, or warning line system and safety monitoring system. Or, on roofs 50-feet (15.25 m) or less in width, each employee was not protected by use of a monitoring system. At the back side of the structure on May 6, 2013, an employee performing roof repairs was not protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems. Employee was exposed to a fall hazard of about 14 feet from the roof to the asphalt surface.

29 CFR 1926.602(c)(1)(vi): Industrial trucks in use did not meet the applicable requirements of design, construction, stability, inspection, testing, maintenance, and operation, as defined in American National Standards Institute B56.1-1969, Safety Standard. At the back side of the structure on May 6, 2013, the seat bottom of the Komatsu 20 Forklift, license number 206 SEQ, was not replaced parts equivalent as to safety with those used in the original design. The original seat was replaced with plywood and secured to the seat frame assembly.
