OSH ACT of 1970 Section (5)(a)(1): Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to crushing injuries: (a) Facility, #3 Warehouse: On or about May 2, 2013, an employee was observed operating a Yale lift truck without wearing the seat belt. Among other methods, one feasible and acceptable means of abatement is to enforce the use of seat belts when operating industrial fork trucks.
