OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees from combustible dust which would cause burns and explosions from accumulated saw dust in and around ingnition sources.  a)          Building 10- Morgan saw electrical box:  On or about May 1st, 2013 and prior to, employees were exposed to fire hazards due to accumulated wood dust of 1/32nd of an inch deep, with a KsT value of 23.77 bar meters per second inside the Morgan electrical box with an ignition source of the live electricity inside electrical box of the Morgan Saw.  b)          Building 10- Equipment and floor:  On or about May 1st , 2013, and prior to, employees were exposed to fire hazards due to accumulated wood dust of over 1/4 inch deep, with a KsT value of 23.77 bar meters per second on the west wall of building 10 at approximately 6 foot high with an ignition source of the electrical box of the Morgan saw and PVC duct work used for the outside west wall dust collector.  Among other methods, a feasible abatement method to correct this hazard, such as, but not limited to:     The National Fire Protection Association standard - NFPA 664:  Standards for the Prevention of Fires and Explosions in Wood Processing and Woodworking Facilities 2007 edition, Chapter 8 -Processes, Operations and Special Systems, 8.2.2.2 Duct Systems    8.2.2.2.1.1       Ductwork shall be metallic.    8.2.2.2.1.2       Nonconductive ducts such as PVC pipes shall not be permitted.

29 CFR 1910.95(k)(2): The training program was not repeated annually for each employee included in the hearing conservation program. Information in the training program was not updated to be consistent with changes in protective equipment and work processes:   a)  Production Area :   On or about May 1st, 2013 the employer exposed employee(s) to noise at levels of 108.2% (equivalent to an 8 hour time weighted average TWA of 90.5685 dBA) which is 2.16 times the Action Level of 50 % (equivalent to an 8 hour TWA of 85 dBA) while sorting in the production area.  Results were calculated for a 421 minute sampling period excluding a 30 minute lunch.  The employer failed to provide training.    b)  Combination Pallet Station :   On or about May 1st, 2013 the employer exposed employee(s) to noise at levels of 237.4 % (equivalent to an 8 hour time weighted average TWA of 96.23 dBA) which is 2.374 times the Permissible Exposure Limit of 100 % (equivalent to an 8 hour TWA of 90 dBA) while operating a nail gun at the combination pallet station.  Results were calculated for a 425 minute sampling period excluding a 30 minute lunch.  The employer failed to provide training.   c)  Trim Saw Operator :   On or about May 1st, 2013 the employer exposed employee(s) to noise at levels of  121% (equivalent to an 8 hour time weighted average TWA of 91.3810dBA) which is 2.42 times the Action Level of 50 % (equivalent to an 8 hour TWA of 85 dBA) while operating the trim saw.  Results were calculated for a 393 minute sampling period excluding a 30 minute lunch.  The employer failed to provide training.
