29 CFR 1910.95(c)(1): The employer did not administer a continuing, effective hearing conservation program as described in 29 CFR 1910.95(c) through (o) whenever employee noise exposures equal or exceed an 8-hour time-weighted average sound level of 85 decibels measured on the A scale, or equivalently a dose of fifty percent:    a)  The company did not have a hearing conservation program written or implemented to including but not limited to audiomentric testing, trainining of employees or enforcement for the use of hearing protetion.   Sampling for noise exposure had not been conducted by the company in the area.    The machine operator in the slicing area was exposed to continuous noise at 100.2% of the permissible daily noise exposure (8-hour time weighted average sound level of 90 dBA) or an equivalent sound level of approximately 90.0 dBA during the 457 minure sampling period on May 14, 2013;  exposure calculation include a zero increment for the 23 minutes not sampled.
