29 CFR 1926.20(b)(2): The employer did not develop an accident prevention program, that provided for frequent and regular inspections of the job sites, materials, and equipment, to be made by competent persons designated by the employer. a) 74 Virginia Dr., Berlin, NJ: FCJ Construction, Inc, as the controlling employer, did not initiate a program for a competent person to conduct frequent and regular inspections of the jobsite, to identify hazards and/or stop the work in the event workers were placed in a hazardous condition. As such, two Five Star Quality Construction employees installing roof sheathing were not using fall protection (PFAS, safety nets, guardrails, etc.) and were thus exposed to fall hazards of greater than 14 feet, from the roof to the ground. Additionally, an aluminum extension ladder with a broken rung was used by employees to access the roof of the structure. Observed on or about 5/07/2013. NOTE: IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM. FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.
