29 CFR 1910.95(c)(1): The employer does not administer a continuing, effective hearing conservation program as described in 29 CFR 1910.9(c) through (o) whenever employee noise exposures equal or exceed an 8-hour time-weighted average sound level of 85 decibels measured on the A scale, or equivalently a dose of fifty percent:  Location: Shop    This violation was most recently observed on April 26, 2013, which respect to a workplace located at 32 Industrial Court, Seekonk, MA, where an employee was operating the grinding equipment and was exposed to a noise level of 87.4 decibels measured on the A scale, or 70% equivalent dose, in excess of the Action Level of 85 decibels (50% equivalent dose).  Prior violations referred to include a violation of this Occupational Safety and Health Standard that was contained in: Nu-Chrome, Incorporated was previously cited for a violation of this occupational safety and health standard or its equivalent standard, which was contained in OSHA inspection number 439653, citation number 1, item number 1, issued on October 12, 2012, and which was affirmed as a final order on November 8, 2012, and with respect to a workplace located at 161 Graham Road, Fall River, MA 02720.  "To abate this violation, the employer must administer a continuing, effective hearing conservation program as described in 29 CFR 1910.95(c) through (o), whenever employee noise exposures equal or exceed an 8-hour time-weighted average sound level of 85 decibels measured on the A scale, or equivalently a dose of fifty percent."  Pursuant to 29 CFR 1903.19, the employer must submit documents describing the steps it has taken to ensure compliance including, but not limited to, program improvements, noise monitoring results, audiometric evaluations, training, type of hearing protection available and other appropriate measures.

29 CFR 1910.141(d)(1): Washing facilities are not maintained in a sanitary condition:  Location: Bathroom   This violation was most recently observed on April 26th, 2013, with respect to a workplace located at 32 Industrial Court, Seekonk, MA where: employees were exposed to infectious disease hazards from unsanitary bathroom conditions. The garbage was overflowing, the sink was filled with black dirt, and there was no handwashing soap or toilet paper.   Prior violations referred to include a violation of this Occupational Safety and Health Standard, which was contained within:  Nu-Chrome, Incorporated was previously cited for a violation of this occupational safety and health standard or its equivalent standard, which was contained in OSHA inspection number 439653, citation number 1, item number 3, issued on October 12, 2012, and was affirmed as a final order on November 8, 2012 with respect to a workplace located at 161 Graham Road, Fall River, MA 02720.  To abate this violation, the employer must administer a continuimg and effective housekeeping program to ensure compliance with 29 CFR 1910.141(d)(1) and (d)(2)(i) through (iv).  Pursuant to 29 CFR 1903.19, the employer must submit documents describing the steps it has taken to ensure compliance, including, but not limited to: supplying toilet paper and soap, developing a cleaning schedule, performing regular inspections to ensure cleanliness and adequate supplies, and other appropriate actions.

29 CFR 1910.1200(f)(5)(ii): The employer does not ensure that each container of hazardous chemicals in the workplace was labeled, tagged, or marked with the appropriate hazard warnings:  Location: Shop  This violation was most recently observed on April 26th, 2013, with respect to  a workplace located at 32 Industrial Court, Seekonk, MA, where employees were exposed to hazardous chemicals in containers that were not properly labeled, including:  1) The "Copper Strike" tank did not have a label on it indicating that it contained potassium cyanide. 2) The nickel plating tank did not have a label on it 3) The trivalent chrome tank did not have a label on it  4) The tank containing hydrochloric acid did not have a label on it 4) The alkaline cleaning tank had no identification of the chemical contained within (sodium hydroxide) 5) The acid copper tank had no identification of the chemical contained within (sulfuric acid)  Prior violations referred to include a violation of this Occupational Satety and Health Standard, which was contained in:  Nu-Chrome, Incorporated was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1910.1200(f)(5)(ii), which was contained in OSHA inspection number 439653, Citation number 2, item number 1, issued on October 12, 2012,  and affirmed as a final order on November 8, 2012, with respect to a workplace located at 161 Graham Road, Fall River, MA, 02720.  To abate this violation, the employer must administer a continuing and effective hazard communication program to ensure compliance with 29 CFR 1910.1200(f).  Pursuant to 29 CFR 1903.19. the employer must submit documentation describing the steps it has taken to ensure complaince, including, but not limited to: pictures of tanks with proper labeling, written plans, regular evaluations, training, and other appropriate activities.
