29 CFR 1926.651(k)(2): Where the competent person found evidence of a situation that could result in possible cave-in, indications of failure of protective systems, hazardous atmospheres, or other hazardous conditions, exposed employee(s) was/were not removed from the hazardous area until the necessary precautions have been taken to ensure their safety. (a) On or about May 10th, 2013, and at times prior, employees were exposed to injuries from cave-in while installing a water line in a 5.5 ft. deep unprotected excavation when the competent person did not remove them from the hazardous area.

29 CFR 1926.652(a)(1): Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with 29 CFR 1926.652(c): (a) On or about May 10th, 2013 and at times prior, employees were exposed to injuries while installing a 30 inch water line in an excavation measuring 5.5 feet deep. No protective system was in place. T. Lowell Construction, Inc. was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.652(a)(1), which was contained in OSHA inspection number 312137540, citation number 2, item number 1 and was affirmed as a final order on January 15, 2009, with respect to a workplace located at S. Quebec St. & Belleview, Greenwood Village, CO. T. Lowell Construction, Inc. was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.652(a)(1), which was contained in OSHA inspection number 110485547, citation number 1, item number 1 and was affirmed as a final order on June 15, 2007, with respect to a workplace located at Hwy 86, two miles east of Founders Parkway, Castle Rock, CO. T. Lowell Construction, Inc. was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.652(a)(1), which was contained in OSHA inspection number 309192490, citation number 1, item number 2a and was affirmed as a final order on August 24, 2006, with respect to a workplace located at 199 E.
