OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that: a. On or about April 30, 2013, at the above addressed jobsite, an employee was exposed to falls of twelve (12) feet while conducting bolting operations from a plank that was placed on the midrails of a JLG scissor lift. Among other methods, feasible and acceptable means to correct these hazards are to use safe alternative methods, such as comply with ANSI/SIA A92.6-1999 for Self Propelled Elevated work Platforms, Section 7.10.9, which states: "Personnel shall maintain a firm footing on the platform floor while working. The use of planks, ladders, or any other devices on the platform for achieving additional height or reach is prohibited."

29 CFR 1926.502(d)(16)(iii): Personal fall arrest systems, were not rigged such that an employee can neither free fall more than 6 feet (1.8 m), nor contact any lower level; a. On or about April 30, 2013, at the above addressed jobsite, an employee conducting bolt up operations from a plank set between the midrails of a JLG scissor lift was not protected from free falling more than six (6) feet. thereby exposing the employee to the hazards associated with falls.
