29 CFR 1910.132(d)(1)(i): When the employer had assessed the workplace hazard(s) and determined that hazard(s) were present, the employer did not select and/or use the types of personal protective equipment that would protect the affected employee from the hazard:  a. Where a personal protective hazard assessment had been conducted and irritating chemicals were identified as presenting exposure to hands/arms in the Color Change department, the protective sleeves option (or arm length gloves as were subsequently provided) had not been identified as personal protective equipment to be used.  b. For color change, where chemical splashes were identified as work related exposure to the eyes/face, the work activity was not checked on the assessment.    c. For color change, where chemical splashes were identified as work related exposure to the body/skin, and an apron was marked as the required personal protective equipment to be used, employees did not use an apron.  Abatement documentation is required for this violation.

29 CFR 1910.1200(h)(1): Employees were not provided effective information and training on hazardous chemicals in their work area at the time of their initial assignment and whenever a new hazard that the employees had not been previously trained about was introduced into their work area:  a. In the color change and mix room departments, where solvents were used to clean parts and where potential exposure existed to other chemicals, such as platicizers, resins, and pigments, employees were not trained on the specific chemical hazards, such as by reviewing material safety data sheets on the chemicals where exposure did exist.  b. When employees were transferred from one department to another, where new or different chemical hazards were present, chemical hazard communication training was not updated.

29 CFR 1910.1020(e)(1)(iii)(A): When an employee or designated representative requested a copy of a record the record was not provided (or other means made available):  a. Where an employee or designated employee represented requested copies of material safety data sheets that represented exposure or potential exposure, an incomplete number of data sheets were provided.  Data sheets provided included F-140 Solvent, Formolon, Gold Plastisol, 14EX Spray Detergent, United F539, and Jay Flex DINP.  Other chemical products that presented potential exposure, but their data sheets were not provided, were Crystal Clean 142+ Mineral Spirits, Jayflex TINTM, Plastistab 2296, Mesamoll, Eastman TXIB, PQ Lime Paste DINP, White 28 DINP,Black 89 DINP, Aruldite GY 6010, ST-0219 Mold Release, SEM204 Mold Release, Mineral Spirits, Luperox, Ircogel, Therm-Chek 363425 Lb Drm, Ground Limestone, White Protopet 1S Petrolatum (petroleum jelly).  Abatement documentation is required for this violation.
