29 CFR 1910.120(q)(3)(ii): The individual in charge of the incident command system did not identify, to the extent possible, all hazardous substances or conditions present and did not address, as appropriate, site analysis, use of engineering controls, maximum exposure limits, hazardous substance handling procedures and the use of any new technologies:    Loading Dock:  The Incident Commander (IC), who was in charge of the clean-up operation of the 05/14/2013 hazardous chemical spill did not ensure that all hazardous vapor concentrations were identified prior to allowing employees to engage in the clean-up operation of the chemical spill.

29 CFR 1910.178(n)(15): While negotiating turns, speed shall be reduced to a safe level by means of turning the hand steering wheel in a smooth, sweeping motion. Except when maneuvering at a very low speed, the hand steering wheel shall be turned at a moderate, even rate.    Loading Dock: The employer did not ensure through providing appropriate training, instruction, visual observation and other means that the operators of the powered industrial trucks (PIT) were reducing the speed to a safe level at all times while negotiating turns to prevent not only the PIT from tipping over, but also the load from shifting.       On or about 05/14/2013, the load, approximately 30 to 40 gallons of flammable liquids contained within a 55-gallong drum which was placed on a wooden pallet and transported by a PIT, shifted while the PIT was negotiating to make a sharp 90-degree turn.

29 CFR 1910.178(o)(1): Load(s) on powered industrial truck(s) were not stable or safely arranged:    Loading Dock: The load/a 55-gallon drum, containing approximately 30 to 40 gallons of flammable liquids and was being transported by a powered industrial truck (PIT) was not positively secured to the PIT to prevent the drum from shifting.     On or about 05/14/2013, the above drum was shifted and fell on the ground while the PIT was negotitiating to make a sharp 90-degree turn.
