29 CFR 1926.652(g)(1)(iii): Employees were not protected from the hazard of cave-ins when entering or exiting the area protected by shields: (a) Mr. Excavator, Inc. On or about May 15, 2013, at the site located on N. Main St (between Union and Walnut streets) in Oberlin, OH: The employer did not ensure an employee was adequately protected from cave-ins when exiting the confines of the shieling system to perform work tasks. The employee operating in the 11.2 ft. deep trench was exposed to cave-ins after exiting the north shieling system to grade out stone in an unprotected area, approximately 8 ft. long between the installed north and south shielding systems.

29 CFR 1926.651(c)(2): A stairway, ladder, ramp or other safe means of egress was not located in trench excavations that was 4 feet (1.22 m) or more in depth so as to require no more than 25 feet (7.62 m) of lateral travel for employees. (a) Mr. Excavator, Inc. On or about May 15, 2013, at the site located on N. Main St (between Union and Walnut streets) in Oberlin, OH: The employer failed to ensure a safe means of egress such as a ladder was provided to an employee connecting a sewer main in a 11.2 ft. deep shielded trench. Mr. Excavator, Inc. was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.651(c)(2), which was contained in OSHA inspection number 315367193, citation number 2, item number 1 and was affirmed as a final order on April 27, 2011, with respect to a workplace located at Rt. 306 and Eisenhower Rd. Kirtland, OH.
