1926.21(b)(2): The employer shall instruct each employee in the recognition and avoidance of unsafe conditions and the regulations applicable to his work environment to control or eliminate any hazards or other exposure to illness or injury: a. On or about July 12, 2024, during the installation of a waste water system located at the worksite of 1250 Gemini Place, Columbus, Ohio, the employer did not ensure employees working inside a trench, with a depth of approximately 6 feet, were protected from cave-ins by an adequately designed protective system. Mr. Excavator, Inc. was previously cited for a violation of this Occupational Safety and Health standard or its equivalent standard 1926.652(b)(1)(i), which was contained in OSHA inspection number 1610261, citation number 1, item number 1 and was affirmed as a final order on August 30, 2022, with respect to a workplace located at 7676 Reynolds Road, Mentor, Ohio.
