29 CFR 1910.95(g)(6): At least annually after obtaining the baseline audiogram, the employer did not obtain a new audiogram for each employee exposed at or above an 8-hour time-weighted average of 85 decibels:  CSM Bakery Products NA, Inc. - on or about May 31, 2013, employees working in production areas of the facility were exposed to occupational noise levels in excess of the Action Level (50% of permissible noise) and were not given annual audiometric tests.  a)  In the Sugar Room, an employee was exposed to continuous noise levels at 162.45% of the allowable 8-hour time-weighted average (TWA) sound level (85 dBA).  The equivalent dBA level of 162.45% is approximately 93.5 dBA.  Sampling was performed for 396 minutes during one shift on May 31, 2013.  Zero exposure was assumed for the unsampled time of 84 minutes.  b)  In the Red Floor area, an employee was exposed to continuous noise levels at 67.83% of the allowable 8-hour TWA sound level (85 dBA).  The equivalent dBA level of 67.83% is approximately 87.2 dBA.  Sampling was performed for 381 minutes during one shift on May 31, 2013.  Zero exposure was assumed for the unsampled time of 99 minutes.  In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included with your certification. This documentation may include, but is not limited to, evidence of the purchase or repair of the equipment, photographic or video evidence of abatement, or other written records.
