29 CFR 1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b): At jobsite located at 903 Second Avenue, Kearney, NE: The employer failed to ensure that employees working on the roof of the New Victorian Inn were protected from fall heights greater than 6 feet as required by this standard. Employees were observed performing roofing installation and tear off, some of the employees were wearing hearnesses but were not connected to an anchor point with a rope slide or approved lanyard, other employees were not utilizing any form of conventional fall protection.

29 CFR 1926.503(a)(1): The employer did not provide a training program for each employee potentially exposed to fall hazards to enable each employee to recognize the hazards of falling and the procedures to be followed in order to minimize these hazards: Jobsite located at 903 Second Avenue, Kearney, NE: The employer failed to provide training for employees exposed to fall hazards as required by this standard. On or about May 8, 2013 employees of Jose Construction were exposed to fall heights greater than 17 feet while performing asphalt shingle roofing replacement.
