29 CFR 1926.1053(b)(16): Portable ladders with structural defects, such as, but not limited to, broken or missing rungs, cleats, or steps, broken or split rails, corroded components, or other faulty or defective components, were not either immediately marked in a manner that readily identified them as defective, or tagged with Do Not Use or similar language, and were not withdrawn from service until repaired:    a) On or about 05/15/13 CSHO observed four men use a 28 foot aluminum extension ladder to access the roof when this ladder was damaged in that it was missing one of the lock assemblies. In addition, Archer Field Superintendent was on site as he delivered roofing materials, inspected jobsite and was directing subcontractor's work.

29 CFR 1926.501(b)(13): Each employee engaged in residential construction activities 6 feet or more above the lower levels was not protected by guardrail systems, safety net systems, personal fall arrest systems, nor was an alternative fall protection plan which meets the requirements of 29 CFR 1926.502(k) developed and implemented:     On or about 05/15/13 CSHO observed four employees of Quiros Construction & Renovation working on and from the roof of a two story apartment complex installing new roofing materials with no fall protection systems in place. This work was being directed by the Field Superintendent of Archer Exteriors.      Archer Exteriors was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.501(b)(13), which was contained in OSHA inspection number 574518, citation number 1, item number 1 and was affirmed as a final order on 03/12/2013, with respect to a workplace located at 19 Petunia Drive, Building 1, North Brunswick, NJ 08902.
