29 CFR 1910.178(o)(1): Unstable or unsafely arranged loads were handled. Caution was not exercised when handling off-center loads which cannot be centered: The Port of Wilmington Delaware, M/V Trans Summer, No. 4 Hold (forward / port side) - Stevedores working in close proximity to remaining unstably stacked coiled wire rod cargo were exposed to a crushing hazard from shifting, falling cargo pieces, as the employer did not ensure that this cargo was stably and safely arranged prior to considering methods to move this cargo such as by utilizing a forklift. On or about May 16, 2013. Pursuant to 29 CFR 1903.19, the employer must submit abatement certification and documentation, required within 10 days after abatement date. The certification shall include a statement that abatement is complete, the date and method of abatement, and state that employees and their representatives were informed of this abatement. Abatement documentation shall include documents demonstrating that abatement is complete, such as evidence of the purchase or repair of equipment, photographic or video evidence of abatement or other written records.

On or about May 16, 2013. Pursuant to 29 CFR 1903.19, the employer must submit abatement certification and documentation, required within 10 days after abatement date.
