29 CFR 1910.134(c)(1): In any workplace where respirators are necessary to protect the health of the employee or whenever respirators are required by the employer, the employer did not establish and implement a written respiratory protection program with worksite specific procedures: a) Right Rear of the Development - An employee performed intermittant brick cutting actiivites and was required by the employer to wear a respirator while performing those duties. The employer did not have a written respirator protection program in place with the required worksite-specific procedires and elements for required respirator use, thereby exposing the employee to the possibility of a hazard, reported on or about 5-16-13. Abatement certification required.

29 CFR 1910.134(g)(1)(i)(A): Respirators with tight-fitting facepieces were worn by employees who had facial hair that came between the sealing surface of the facepiece and the face or that interfered with valve function: (Construction Reference 1926.103) a) Right Rear of the Development - An employee performed intermittant brick cutting actiivites and was required by the employer to wear a respirator while performing those duties. The employee had a beard that came between the sealing surface of the respirator and the face, thereby exposing the employee to a hazard, on or about 5-16-13. Abatement certification required.
