Multiple 5 gallon containers of paint were stored in the painting area.  This condition exposes employees to a fire hazard.

29 CFR 1910.132(d)(2):  The employer did not verify that the required workplace hazard assessment has been performed through a written certification which included the requirements as outlined in 29 CFR 1910.132(d)(2):  (a) Teilhaber Manufacturing Corporation at 2360 Industrial Lane, Broomfield, CO 80020:  On May 21, 2013, the employer did not ensure through written verification that a workplace personal protective equipment (PPE) hazard assessment had been performed.  Employees conducted hazardous operations which include exposure to paint solvents, noise, and welding fumes.   Abatement Note:  The written certification shall identify the following:  (1)  The workplace evaluated;  (2)  The person certifying that the evaluation has been performed;  (3)  The date(s) of the hazard assessment; and,  (4)  The document as a certification of hazard assessment.

29 CFR 1910.134(c)(2)(ii):  The employer did not establish and implement those elements of a written program necessary to ensure that any employee using a respirator voluntarily was medically able to use that respirator, and that the respirator was cleaned, stored, and maintained so that its use does not present a health hazard to the user:   (a) Teilhaber Manufacturing Corporation at 2360 Industrial Lane, Broomfield, CO 80020: On May 21, 2013, the employer did not ensure that any employee using a respirator voluntarily was medically able to use the respirator.  The employer provided tight-fitting facepiece respirators for voluntary use and did not ensure that employees received a medical evaluation prior to initial use of the respirator.  This condition exposes employees to the physiological hazards of wearing a respirator without the evaluation of a physician or other licensed healthcare professional.

29 CFR 1910.1200(e)(1):  The employer did not develop, implement, and/or maintain at the workplace a written hazard communication program which describes how the criteria specified in 29 CFR 1910.1200(f), (g), and (h) will be met:  (a) Teilhaber Manufacturing Corporation at 2360 Industrial Lane, Broomfield, CO 80020:  On May 21, 2013, the employer did not develop, implement, and maintain at the workplace a site specific written hazard communication program which describes how the criteria specified in 29 CFR 1910.1200(f), (g), and (h) will be met.  The employer utilizes products such as, but not limited to, Xylene, Cardinal Paint, and phosphoric acid.  Abatement note:  The written hazard communication program will also include:  (1) A list of the hazardous chemicals known to be present using an identity that is referenced on the appropriate material safety data sheet (the list may be compiled for the workplace as a whole or for individual work areas); and,  (2) The methods the employer will use to inform employees of the hazards of non-routine tasks.
