29 CFR 1926.501(b)(13): Each employee engaged in residential construction activities 6 feet (1.8 m)  or more above lower levels was not protected by guardrail systems, safety net systems, personal fall arrest systems, or an alternative fall protection measure under another provision of paragraph 1926.501 (b), nor did the employer demonstrate that it is infeasible or creates a greater hazard to use these systems and develop and implement a fall protection plan which meets the requirements of paragraph (k) of section 1926.502:    On or about May 20, 2013, while performing tear off and replacement of roofing materials from a residential roof, the employer failed to ensure employees working from a 12/12 pitch roof were protected from a fall of approximately 12 feet by using an adequate fall protective system/ devices. The employer failed to prove infeasibility or the presence of a greater hazard. The employer developed a fall protection plan under 1926.502(K), however the plan was not site specific as required by the standard.   AMERICAN ROOFING INC., WAS PREVIOUSLY CITED FOR A REPEAT VIOLATION OF THIS OCCUPATIONAL SAFETY AND HEALTH STANDARD OR ITS EQUIVALENT STANDARD 29CFR 1926.501(B)13), WHICH WAS CONTAINED IN OSHA INSPECTION NUMBER 315622498, CITATION NUMBER 01 ITEM 01 AND WAS AFFIRMED AS FINAL ORDER ON OCTOBER 25, 2012, WITH RESPECT TO A WORKPLACE LOCATED AT 30336 LAKE ROAD, BAY VILLAGE, OH 44140.   AMERICAN ROOFING INC., WAS PREVIOUSLY CITED FOR A VIOLATION OF THIS OCCUPATIONAL SAFETY AND HEALTH STANDARD OR ITS EQUIVALENT STANDARD 29CFR 1926.501(B)13), WHICH WAS CONTAINED IN OSHA INSPECTION NUMBER 315057992, CITATION NUMBER 01 ITEM 0100A AND WAS AFFIRMED AS FINAL ORDER ON FEBRUARY 9, 2009, WITH RESPECT TO A WORKPLACE LOCATED AT 1068 SLYVAN AVE., LAKEWOOD, OH 44107.
