29 CFR 1910.23(a)(2): Every ladder way floor opening or platform shall be guarded by a standard railing with standard toe board on all exposed sides (except at entrance to opening), with the passage through the railing either provided with a swinging gate or so offset that a person cannot walk directly into the opening.  a.    In the Leg Building where employees clean floors and equipment,  the ladder between levels where the soy beans are received and moved to the bins, the ladder way did not have a swinging gate thereby exposing employees to a fall hazard.

29 CFR 1910.23(c)(1): Every open-sided floor or platform 4 feet or more above adjacent floor or ground level shall be guarded by a standard railing (or the equivalent as specified in paragraph (e)(3) of this section) on all open sides except where there is entrance to a ramp, stairway, or fixed ladder.   a.     At the loading platform where employees unload trucks, the discard platform did not have a proper guardrail system thereby exposing employees to a fall hazard.  b.     In the discard area where employees work on the equipment overtop of the loading area, the platform from the ladder to the equipment did not have a guardrail system thereby exposing employees to a fall hazard.

29 CFR 1910.27(d)(4): "Grab bars." Grab bars shall be spaced by a continuation of the rung spacing when they are located in the horizontal position. Vertical grab bars shall have the same spacing as the ladder side rails. Grab-bar diameters shall be the equivalent of the round-rung diameters.  a.    In the loading area where employees gained access to the walk platform to the Pneunafil Aspiration System, there were no grab rails to assist employees to gain access to the walk platform thereby exposing employees to a 11'10" fall hazard.

29 CFR 1910.212(a)(1): Types of guarding. One or more methods of machine guarding shall be provided to protect the operator and other employees in the machine area from hazards such as those created by point of operation, ingoing nip points, rotating parts, flying chips and sparks. Examples of guarding methods are-barrier guards, two-hand tripping devices, electronic safety devices, etc.  a.    On the second level of the Plant Tower where employees retrieved bags of meal to polish the soy beans, the main cleaner annex conveyer was not properly guarded thereby exposing employees to a caught-in hazard.   b.     On the first floor of plant tower where employees climb the stairs to the Hurada  machine, the rollers were unguarded thereby exposing employees to a caught-in hazard.  c.     On the main floor of the plant beside the Gravity Table, their were unguarded parts to the conveyor thereby exposing employees to a caught-in hazard.

Vertical and inclined shafting seven (7) feet or less from floor or working platform, excepting maintenance runways, shall be enclosed with a stationary casing in accordance with requirements of paragraphs (m) and (o) of this section.  a.    On the second level of the Plant Tower, there was an 4 inch unguarded horizontal shaft located 40 inches from the floor which was not completely guarded thereby exposing employees to a caught-in hazard.  b.     On the second level of the Plant Tower, there was a 2 inch unguarded horizontal shaft on the main cleaner located 14 inches from the floor which was not completely enclosed thereby exposing employees to a caught-in hazard.

On the Aspiration Platform, the guard around the belt and pulley which was located 32 inches from the floor was  open to the belt and pulley thereby exposing employees to a caught-in hazard.  b.      On the second floor of the plant tower where soy beans are separated and processed, there was an unguarded belt and pulley on the pre cleaner thereby exposing employees to a caught-in hazard.  c.       On the second floor of the plant tower where soy beans are separated, cleaned and processed, there was a unguarded belt and pulley on the main cleaner thereby exposing employees to a caught-in hazard.
