29 CFR 1910.178(a)(4): Modifications and additions which affect capacity and safe operation shall not be performed by the customer or user without manufacturers prior written approval. Capacity, operation, and maintenance instruction plates, tags, or decals shall be changed accordingly. a. On or about March 25, 2024, employees worked off a fabricated platform to conduct light bulb exchange at the worksite location. The employer used the fabricated platform without obtaining the manufacturers approval when the platform was attached and elevated when employees conducted the light bulb exchange task.

29 CFR 1910.178(a)(5): If the truck is equipped with front-end attachments other than factory installed attachments, the user shall request that the truck be marked to identify the attachments and show the approximate weight of the truck and attachment combination at maximum elevation with load laterally centered. a. On or about March 25, 2024, the employer used the fabricated platform to conduct elevated work without ensuring that the forklift truck was marked accordingly to identify the adjusted weight when the platform was attached and used by the employees when they conducted work from the raised fabricated platform.

29 CFR 1910.178(l)(4)(i): Refresher training, including an evaluation of the effectiveness of that training, shall be conducted as required by paragraph (l)(4)(ii) to ensure that the operator has the knowledge and skills needed to operate the powered industrial truck safely. 29 CFR 1910.178(l)(4)(iii): An evaluation of each powered industrial truck operator's performance shall be conducted at least once every three years. a. On or about March 25, 2024, employees operated forklifts to conduct materials handling for products at the worksite location. The employer did not ensure that the employees were reevaluated at least every three years to ensure that they maintained the knowledge and skills to safely operate the forklifts.
