29 CFR 1910.95(c)(1):  A continuing, effective hearing conservation program as described in 29 CFR 1910.95(c) through (n) was not instituted when employee noise exposures equaled or exceeded an 8-hour time-weighted average (TWA) sound level of 85 dBA:    An effective hearing conservation program which included noise monitoring, audiometric testing of employees and training of employees as detailed in the standard was not instituted by Inplex Custom Extruders, LLC.    a) An employee, grinding the Hog Slat hose using the Molding Systems Inc. Polygrinder (serial  # 12016980), was exposed to continuous noise levels at 79.1 % of the allowable 8-hour time weighted average sound level (85 dBA). The equivalent dBA level of 79.1 % is approximately 88.3 dBA.  The sampling was performed for 402 minutes during one shift on May 30, 2013.  Zero exposure was assumed for the unsampled period of time, 78 minutes.     In accordance with 29 CFR 1903.19(c), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET).

29 CFR 1910.95(d)(1): When information indicated that any employee's exposure equaled or exceed the 8-hour time-weighted average of 85 decibels, the employer did not develop and implement a monitoring program:  a) On or about May 30, 2013 Inplex Custom Extruders, LLC did not develop and implement a noise monitoring program when information indicated that any employee's exposure to noise equaled or exceeded an 8-hour time-weighted average of 85 decibels.  Employees were exposed to noise levels during grinding of Hog Slat hose on the Molding Systems Inc. Polygrinder (ser# 112016980) at an 8-hour time-weighted average of 88.3 dBA.  In accordance with 29 CFR 1903.19(c), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET).

Employees were not provided training on the hazards associated with noise, or the correct way to wear hearing protection.  Employees were exposed to noise levels during grinding of Hog Slat hose on the Molding Systems Inc. Polygrinder (ser# 112016980) to an 8-hour time-weighted average of 88.3 dBA.  In accordance with 29 CFR 1903.19(c), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET).

29 CFR 1910.1200(e)(1): The employer did not develop, implement, and/or maintain at the workplace a written hazard communication program which describes how the criteria specified in 29 CFR 1910.1200(f), (g), and (h) will be met:  a) Inplex Custom Extruders, LLC, the employer did not develop or implement a written hazard communication program in accordance with 29 CFR 1910.1200(e)(1) that would describe or include at least the following:  1) Requirement for labeling of containers of hazardous chemicals; 2) Material safety data sheet availability; 3) Training of employees; 4) A complete list of hazardous chemicals known to be in the workplace; 5) Methods to inform employees of the hazards on non-routine tasks; and 6) Methods to inform other employer(s) of material safety data sheet availability; the labeling system; and any precautionary measures to protect employees.  Employees were exposed to hazardous chemicals, including, but not limited to: isopropyl alcohol, MEK, and acetone.  In accordance with 29 CFR 1903.19(c), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET).
