29 CFR 1926.1440(c)(10): Sideboom cranes mounted on wheel or crawler tractors did not meet all of the following requirements of ASME B30.14-2004 (incorporated by reference, see � 1926.6) In section 14-3.1.2 ("Operator Qualifications"), paragraph (a), except the phrase "When required by law." Operators shall be required to pass a practical operating examination, Examinations shall be limited to the specific type equipment that a person will operate: On or about May 21, 2013 the employer did not ensure that the operator of the side boom tractor (pipelayer) passed a practical examination relevant to all operating conditions prior to use, exposing employees to the hazard of being crushed by the pipelayer. And, or in the alternative: 29 CFR 1926.20(b)(4): The employer did not ensure that the employee(s) required to operate equipment and machinery was qualified by training or experience. On or about May 21, 2013 the employer did not ensure that the operator of the side boom tractor (pipelayer) was trained to safely operate the pipelayer prior to use, exposing employees to the hazard of being crushed by the pipelayer.
