And, or in the alternative:   29 CFR 1926.20(b)(4): The employer did not ensure that the employee(s) required to operate equipment and machinery was qualified by training or experience.   On or about May 21, 2013 the employer did not ensure that the operator of the side boom tractor (pipelayer) was trained to safely operate the pipelayer prior to use, exposing employees to the hazard of being crushed by the pipelayer.
