29 CFR 1926.652(a)(1): Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with paragraph (b) or (c) of this section: On May 29, 2013, employees were not protected from a cave-in while working in an unprotected trench, exposing employees to the hazards associated with a cave-in. Perma- Seal Basement Systems, Inc. was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1926.652(a)(1), which was contained in OSHA inspection number 190952, citation number 1, item number 2, and was affirmed as a final order on May 23, 2012 , with respect to a workplace located at 4123 Grand St. Western Springs, Illinois, 60558. Abatement documentation is required for this item in accordance with the requirements of 29 CFR 1903.19(d).
