29 CFR 1910.95(c)(1): The employer did not administer a continuing, effective hearing conservation program as described in 29 CFR 1910.9(c) through (o) whenever employee noise exposures equal or exceed an 8-hour time-weighted average sound level of 85 decibels measured on the A scale, or equivalently a dose of fifty percent:    a)  Fort Bragg Army Military Base: A landscaping equipment operator was exposed to continuous noise at 137.8% of the permissible daily noise exposure (8 hour time weighted average sound level of 85dBA) or an equivalent sound level of approximately 93.8 dBA during the 388 minute sampling period on May 29, 2013; exposure calculations included zero increment for the 92 minutes not sampled.    b)  Fort Bragg Army Military Base: A landscaping equipment operator was exposed to continuous noise at 90.14% of the permissible daily noise exposure (8 hour time weighted average sound level of 85dBA) or an equivalent sound level of approximately 91.3 dBA during the 375 minute sampling period on May 29, 2013; exposure calculations included zero increment for the 105 minutes not sampled.    c)  Fort Bragg Army Military Base: A landscaping equipment operator was exposed to continuous noise at 70.52% of the permissible daily noise exposure (8 hour time weighted average sound level of 85dBA) or an equivalent sound level of approximately 89.1 dBA during the 378 minute sampling period on May 29, 2013; exposure calculations included zero increment for the 102 minutes not sampled.    d)  Fort Bragg Army Military Base: A landscaping equipment operator was exposed to continuous noise at 126% of the permissible daily noise exposure (8 hour time weighted average sound level of 85dBA) or an equivalent sound level of approximately 93.2 dBA during the 386 minute sampling period on May 29, 2013; exposure calculations included zero increment for the 94 minutes not sampled.
