OSH ACT of 1970 Section (5)(a)(1): Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish to each of his employees employment and a place of employment which are free from recognized hazards that are causing or likely to cause death or serious physical harm to his employees in that employees were exposed to struck-by and crushed-by hazards resulting from the use of an improvised, job-built personnel platform which was attached to a Genie Model No. GTH636 Telescopic Forklift. This violation most recently occurred on May 23, 2013, at a workplace located at 5400 Live Oak Street, Dallas, TX 75206; where at least two (2) employees worked from an improvised, job-made personnel platform that was being elevated by the forks of a Genie GTH636 lift truck.
