29 CFR 1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b):   The employer does not ensure that employees are protected from falling while working at heights greater than six feet. This violation occurred on or about December 20, 2013, when an employee was exposed to a fall hazard while installing tarpaper on the roof of an apartment complex being constructed without any means of fall protection.     Pursuant to 29 C.F.R. 1903.19, within ten (10) calendar days of the abatement date, the employer must submit documentation showing that it is in compliance with the standard, including describing the steps that it is taking to ensure that all employees performing construction activities at heights greater than six feet are protected from falling.

29 CFR 1926.1053(b)(1): Where (a) portable ladder(s) was/were used for access to an upper level landing surface and the ladders length did not allow the ladder side rails to extend at least 3 feet (0.9 m) above the upper landing surface being accessed, the ladder was not secured at its top to a rigied support that will not deflect, and/or a grasping device was not provided to assist emmployees in mounting and dismounting the ladder:   The employer does not ensure that all portable ladders used by employees to access an upper landing have their side rails extended at least three feet above the landing or that it is secured at its top to a rigid support. This violation occurred on or about December 20, 2013, when employees were exposed to a fall hazard while using an extension ladder to access a roof without extending the ladders side rails at least three feet above the roof landing or securing the top of the ladder to the roof landing or other rigid support.     Pursuant to 29 C.F.R. 1903.19, within ten (10) calendar days of the abatement date, the employer must submit documentation showing that it is in compliance with the standard, including describing the steps that it is taking to ensure that all ladders are set up and used in accordance to the requirements of 29 CFR 1926.1053.
