The spacing between the rungs was 20 inches. NO ABATEMENT CERTIFICATION REQUIRED

29 CFR 1926.451(g)(1)(vii): Each employee on a scaffold, not otherwise specified in paragraphs (g)(1)(i) through (g)(1)(vi) of this section, more than 10 feet (3.1 m) above lower level was not protected from falls by the use of personal fall arrest systems or guardrail systems meeting the requirements of paragraph (g)(4) of this section: a) On or about 6/05/13 on construction site of a building under renovation at 765 Elmwood Ave., Buffalo, NY: An employee was standing on a single aluminum "pik" setting on the bottom horizontal member on the third frame up, on a fabricated frame mobile scaffold. The employee was assisting his foreman who was on the roof plumbing up a steel stud. The employee was exposed to a fall of approx. 12 ft. 7 in. off the backside (north side) of the "pik" because no guardrails or other fall protection system was installed to protect the employee. NO ABATEMENT CERTIFICATION REQUIRED

WAS PREVIOUSLY CITED FOR A VIOLATION OF THIS OCCUPATIONAL SAFETY AND HEALTH STANDARD OR ITS EQUIVALENT STANDARD, WHICH WAS CONTAINED IN OSHA INSPECTION NUMBER 903567, CITATION NO. 1, ITEM NO. 1, AND WAS AFFIRMED AS A FINAL ORDER ISSUED ON 06/13/2013, WITH RESPECT TO A WORKPLACE LOCATED AT 4460 CHESTNUT RIDGE ROAD, AMHERST, NY 14226. 29 CFR 1926.404(f)(6): The path to ground from circuits, equipment, or enclosures was not permanent and continuous: a) On or about 6/05/13 on construction site of a building under renovation at 765 Elmwood Ave., Buffalo, NY: A DeWalt 14" Chop Saw used to cut steel studs was connected to 120-volt ac power via a series of two extension cords. The second extension cord (red ext. cord) in the series lacked a grounding prong on its' plug. NO ABATEMENT CERTIFICATION REQUIRED
