29 CFR 1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b): a) At Lot 75 White Oaks Subdivision Auburn, Alabama: On or about June 5, 2013 and at times prior; the employer failed to ensure employees framing on top of the second floor wall had fall protection exposing them to fall hazards of 21.4 feet to the ground below. b. At Lot 75 White Oaks Subdivision Auburn, Alabama: On or about June 5, 2013 and at times prior; the employer exposed his employees to a fall hazards of 11.9 feet to the ground below in that he failed to provide fall protection around the ladder used by employees to gain access to the second level of the house.

29 CFR 1926.1053(b)(1): Where portable ladders were used for access to an upper landing surface and the ladders length allows, the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface being accessed: a) At Lot 75 White Oaks Subdivision Auburn, Alabama: On or about June 5, 2013 and at times prior; the employer failed to ensure a portable extension ladder used on site by employees was extended at least three feet above the landing area exposing them to fall hazards of 11.9 feet to the ground below.
