29 CFR 1926.453(b)(2)(v): A body belt shall be worn and a lanyard attached to the boom or basket when working from an aerial lift. a. On or about June 5, 2013 - at the above addressed jobsite, an employee working in a GENIE S-40 telescopic boom aerial lift was not attached to the boom or basket by the use of a lanyard, thereby exposing the employee to the hazards associated with a fall of more than twenty five (25) feet.

29 CFR 1926.760(a)(1): Except as provided by paragraph (a)(3) of this section, each employee engaged in a steel erection activity who is on a walking/working surface with an unprotected side or edge more than 15 feet (4.6 m) above a lower level shall be protected from fall hazards by guardrail systems, safety net systems, personal fall arrest systems, positioning device systems or fall restraint systems. a. On or about June 5, 2013- at the above addressed jobsite, employees performing caulking operations at the roofs edge more than (25) feet above the ground, were not protected from falls, thereby exposing the employee to fall hazards. THE ADVANCE STEEL ERECTION, INC. WAS PREVIOUSLY CITED FOR A VIOLATION OF THIS OCCUPATIONAL SAFETY AND HEALTH STANDARD OR ITS EQUIVALENT STANDARD 1926.760(a)(1), WHICH WAS CONTAINED IN OSHA INSPECTION NUMBER 464621 , CITATION NUMBER 1, ITEM NUMBER 1 AND WAS AFFIRMED AS A FINAL ORDER ON SEPTEMBER 25, 2012 WITH RESPECT TO A WORKPLACE LOCATED AT 1959 W. GRAND AVENUE, CHICAGO, IL 60622.
