29 CFR 1926.651(c)(2): A stairway, ladder, ramp or other safe means of egress was not located in trench excavations that were 4 feet (1.22m) or more in depth so as to require no more than 25 feet (7.62m) of lateral travel for employees: - The employee who egress a the five feet deep trench to uncover a copper water service line with a hand shovel was not provided a ladder or a earthen ramp as a safe means of egress down in and out of that trench excavation.

29 CFR 1926.651(k)(1): An inspection of the excavations, the adjacent areas, and protective systems was not conducted by the competent person prior to the start of work and as needed throughout the shift: - The competent person onsite did not inspect and reassess the trench excavation throughout the shift and as needed to address the changing conditions of the trench while digging for an existing water service line. The employee was not provided a safe means of egress down in and out of the 5 feet deep trench with nearly vertical side walls.
