29 CFR 1926.21(b)(2): The employer shall instruct each employee in the recognition and avoidance of unsafe conditions and the regulations applicable to his work environment to control or eliminate any hazards or other exposure to illness or injury. On April 4, 2017, located on a two lane urban street, an employee performing flagging operations was exposed to struck-by hazards from vehicular traffic at a Temporary Traffic Control (TTC) zone. The employee had not been instructed by the employer in recognition and avoidance of unsafe conditions to control or eliminate hazards associated with flagging operations.

29 CFR 1926.200(g)(2): All traffic control signs or devices used for protection of construction workers shall conform to Part VI of the Manual of Uniform Traffic Control Devices (AMUTCD"), 1988 Edition, Revision 3, September 3, 1993, FHWA-SA-94-027 or Part VI of the Manual on Uniform Traffic Control Devices, Millennium Edition, December 2000, FHWA, which are incorporated by reference. On April 4, 2017, located on a two lane urban street, employees performing flagging operations at a Temporary Traffic Control (TTC) zone were exposed to struck-by hazards by not utilizing the appropriate devices, such as STOP/SLOW paddle, that conform to Part VI of the Manual of Uniform Traffic Control Devices. Employees were using hand signals to control traffic.

29 CFR 1926.651(c)(2): Means of egress from trench excavations. A stairway, ladder, ramp or other safe means of egress shall be located in trench excavations that are 4 feet (1.22 m) or more in depth so as to require no more than 25 feet (7.62 m) of lateral travel for employees. On April 4, 2017, located on a two lane urban street, an employee was exposed to cave-in hazards while working inside an excavation that had no suitable means of access/egress. Measurements of the excavation were determined to be at least 8 feet in width, 6 feet in height and within 25 feet of the work area within the excavation. GM Pipeline, Inc. was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.651(c)(2), which was contained in OSHA inspection number 910746, citation number 1, item number 1 and was affirmed as a final order on 6/13/13, with respect to a workplace located at 6295 Irwin-Simpson Rd., Mason OH 45040.
