OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees: This violation was most recently observed at Sea Lion Technology on or about June 11, 2013 when the employer failed to ensure the Hydrogen Sulfide vents from T-247 and T-241 was in compliance with API 2000/ISO 28300 Section 4.7.2 (a) and (d). The vent did not lead to a safe location and/or discharge to areas that prevent flame impingement on personnel, tanks, piping, equipment and structures, and prevents vapor from entering enclosed spaces.

29 CFR 1910.1020(b)(3): The employer did not assure that the preservation and access requirements of the employee exposure records are complied with: Alternative 29 CFR 1910.1020(d)(1)(ii): Each employee exposure record shall be preserved and maintained for at least 30 years: This violation was recently observed on or about May 25, 2013 at Sea Lion Technology when the employer did not ensure the employee H2S personal monitor exposure records were documented, maintained and made available when Hydrogen Sulfide gas was relieved to the acidification process area due to flare system failure.
