OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees: (a) On or about October 22, 2015 and at times prior thereto, at the Sea Lion Technology facility located in Texas City, Texas, the employer failed to develop written operating procedures for the hot oil furnace and did not address each phase of operation as required by NFPA 86. Not having procedures exposed workers to fire and explosion hazards from a potential release of fuel gas and other flammable or combustible liquids and or gases.

OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees: (a) On October 22, 2015 and at times prior thereto at the Sea Lion Technology facility in Texas City, Texas, the employer did not ensure that personnel responsible for operating, maintaining, and supervising the hot oil furnace were thoroughly trained in their respective job functions, under the direction of qualified persons as required by NFPA 86. This exposed workers to fire and explosion hazards from potential release of fuel gas and other flammable liquids and/or gases. (b) On October 22, 2015 and at times prior thereto at the Sea Lion Technology facility in Texas City, Texas, the employer did not require personnel responsible for operating, maintaining, and supervising the hot oil furnace to demonstrate understanding of the equipment, its operation and practice of safe operating procedures in their respective job functions as required by industry consensus standard NFPA 86. This exposed workers to fire and explosion hazards from potential release of fuel gas and other flammable liquids and/or gases. This exposed workers to fire and explosion hazards from potential release of fuel gas and other flammable liquids and/or gases.
