29 CFR 1910.95(c)(1): The employer did not administer a continuing, effective hearing conservation program as described in 29 CFR 1910.9(c) through (o) whenever employee noise exposures equal or exceed an 8-hour time-weighted average sound level of 85 decibels measured on the A scale, or equivalently a dose of fifty percent:  (a) On 6/13/13, three employees were determined to be exposed to noise in excess of an 8-hour time-weighted average sound level of 85 decibels while operating gas-powered mowers, trimmers, and blowers. The employer had not administered a continuing, effective hearing conservation program.   The elements of hearing conservation program include the following:  * Developing and implementing a noise monitoring program * Establishing and maintaining an audiometric testing program * Making hearing protection available for employees to wear and giving them the opportunity to select their hearing protection from a variety of hearing protectors (e.g., muffs or plugs). * Instituting a noise training program * Providing employees with a copy of noise standard * Maintaining records of noise monitoring and audiometric testing

29 CFR 1910.253(b)(2)(ii): Assigned storage spaces for cylinders was not located away from elevators, stairs, or gangways where cylinders could not be knocked over or damaged by passing or falling objects, or subject to tampering by unauthorized persons:  (a) A compressed cylinder of acetylene and oxygen were being stored together upright and unsecured adjacent to an exit door on the west side of Building 26. 29 CFR 1910.305(g)(1)(iv): Flexible cords and/ or cables were used for purposes prohibited by paragraphs (A) through (F) of 29 CFR 1910.305(g)(1)(iv):  (a) West side of Building 26: Approximatley 5 extension cords (carrying 120 volts)  were used in lieu of fixed wiring to provide power to such equipment as a parts washer, pedestal fan, lights, drill, press, bench grinder, and portable grinder.  (b) West wall of Building 26: Two orange extension cords which were plugged into a power strip inside the building were run outside through a cut out hole in the metal wall of the building adjacent to an exterior door.  One of the extension cords was being used at a workbench to power handheld equipment (e.g., grinder). The other extension cord extended along the foundation of the building and re-entered the building through a crack between the metal siding and the concrete foundation.   (c) West wall of Buildilng 26: An orange extension cord and a cable to a power strip which the extension cord was plugged into were attached to the metal frame of the building with zip ties.  (d) West side of Building 26: A yellow extension cord which supplied power to a drill press was attached to a metal fence and steel building structures.

(b) A portable ABC fire extinguisher mounted near a rollup door on the north wall of Building 26 was last inspected in August 2011.  (c) A portable ABC fire extinguisher mounted on the west wall of Building 26 was last inspected in July 2008.     (d) A portable ABC fire extinguisher mounted on the east wall of Building 26 was last inspected in August 2011.  (e) A portable ABC fire extinguisher mounted on the south wall of Building 26 was discharged and had not received an annual inspection.
