29 CFR 1910.95(c)(1): The employer did not administer a continuing, effective hearing conservation program as described in 29 CFR 1910.9(c) through (o) whenever employee noise exposures equal or exceed an 8-hour time-weighted average sound level of 85 decibels measured on the A scale, or equivalently a dose of fifty percent: a) Facility An employee working as a GED MC 3000 saw operator was exposed to continuous noise levels that were equivalent to 69.12% of the allowable dose of 100%, or 90dBA for an 8 hour Time Weighted Average. This exposure, which is equivalent to an 8 hour Time Weighted Average of 87.3dBA, exceeded the Action Level of 50%, or 85dBA. The sample time was 373 minutes. Zero exposure was assumed for the unsampled time period of 107 minutes. The employer did not provide audiograms at least annually and the employer did not inform employees of the effects of noise on hearing, the purpose of hearing protectors, the advantages/disadvantages of the various types and instruction on the selection, fitting, use, and care of hearing protectors, and the purpose of the audiometric test and explanation of the test procedures. Violation occurred on or about 07/23/13.
