29 CFR 1926.501(b)(13): 29 CFR 1926.501(b)(13):  Employee(s) engaged in residential construction 6 feet (1.8 m) or more above lower levels were not protected from falling by the use of guardrail systems, safety net systems or personal fall arrest systems nor was an alternative fall protection plan which meets the requirements of 1926.502(k) developed and implemented :  a) At the jobsite, on the roof, on or about 6/21/13:  Employees were on a 3:12 pitch residential roof, with approximate ground to eave heights of 12 and 18 feet, without fall protection.  b) At the jobsite, on the roof, on or about 6/21/13:  Employees were on a 3:12 pitch residentail roof, with approximate ground to eave heights of 12 and 18 feet, without fall protection, observed at a subsequent site visit.    Abatement certification must be submitted for this item.

29 CFR 1926.1053(b)(1): When portable ladders are used for access to an upper landing surface, the ladder side rails shall extend at least 3 feet (.9 m) above the upper landing surface to which the ladder is used to gain access:  a)  At the jobsite, accessing the roof, on or about 6/21/13:  Employees were using an extension ladder to access a roof approximately 15 feet from ground where that ladder did not extend at least 3 feet above the upper landing being accessed.    b)  At the jobsite, accessing an upper roof from a lower roof, on or about 6/21/13:  Employees were using a step ladder placed against the building to access a roof surface where that ladder did not extend at least three feet above that upper landing.    Abatement certification must be submitted for this item.

29 CFR 1926.1053(b)(4): Ladders were not used for the purpose for which they were designed.   a)  At the jobsite, accessing an upper roof from a lower roof, on or about 6/21/13:  Employees were using a step ladder placed against the building to access a roof surface where that ladder did not extend at least three feet above that upper landing and where that ladder was not opened with the spreaders locked as it was designed to be used.    Abatement certification must be submitted for this item.
