29 CFR 1926.651(k)(1): Daily inspections of excavations, the adjacent areas, and protective systems were not made by a competent person for evidence of a situation that could have resulted in possible cave-ins, indications of failure of protective systems a) Jobsite- Next to 208 Sammons Pond St. Middletown, DE - Employees were exposed to cave-in hazards while inside a 6 foot deep excavation with type B soil where 90 degree walls were sloughing and the excavation had not been inspected by a competent person. Observed on or about 6/21/13. NOTE: Pursuant to 29 CFR 1903.19, the employer must submit abatement certification required within 10 days after abatement date. The certification shall include a statement that abatement is complete, date and method of abatement, and states employees and their representatives were informed of this abatement

The certification shall include a statement that abatement is complete, date and method of abatement, and states employees and their representatives were informed of this abatement
