29 CFR 1910.23(c)(1): Open-sided floor(s) or platform(s) 4 feet (1.22 m) or more above the adjacent floor or ground level were not guarded by standard railings (or the equivalent as specified in 29 CFR 1910.23(e)(3)(i) through (v)), on all open sides: a) At Auger and Pit Location in Mill - On and prior to June 26, 2013, employees were exposed to fall hazards (approximately 54" to pit floor) due to lack of guardrails at the entrance to the pit, unstable railing behind the auger, and the railings not meeting the height requirements of a standard railing. A guardrail is necessary to protect employees from a pit classified as a permit required confined space.

29 CFR 1910.146(c)(2): The employer did not inform exposed employees, by posting danger signs or by any other equally effective means, of the existence and location of and the danger posed by the permit spaces: a) The Conveyor in the Mill - On and prior to June 26, 2013, the employer allows employees to enter the pit at the beginning of the conveyor to clean and make repairs. Hazards include but are not limited to moving parts and there is no signage alerting employees to the hazard of the permit required confined space.
