OSH ACT of 1970 Section (5)(a)(1): Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazards of being struck by falling materials.    On or about June 22, 2013 malleable cast iron clips were used in the following locations to make eye splices in wire rope:    a.  Temporary support cables attached to rafters with connections made with malleable cast iron U-bolt type cable clamps.

29 CFR 1926.21(b)(2): The employer did not instruct each employee in the recognition and avoidance of unsafe condition(s) and the regulation(s) applicable to his work environment to control or eliminate any hazard(s) or other exposure to illness or injury:    On or about June 22, 2013 workers were exposed to fall from elevation and struck by structural steel hazards while erecting building 6. The employer failed to train workers in the following hazards:      a. Cross-bracing rods used in the braced bay were not all put in place.  Cross bracing is essential to the building process and makes for a stable structure.  b. All connections were not tightened.  After the bay is erected and aligned, it is necessary to tighten all purlin, grid and flange brace connections.

29 CFR 1926.251(a)(1): Rigging equipment for material handling was not inspected prior to use on each shift and as necessary during its use to ensure that it was safe and defective rigging equipment was not removed from service:    On or about June 22, 2013 a 5/8 inch diameter wire rope sling, serial number 145270-23, 3.9 ton capacity had a hook safety latch that did not close.  The sling was used to lift rafters, exposing employees to the hazards of being struck by falling materials. Where employers elect, due to conditions specific to the site, to develop alternate means and methods that provide employee protection in accordance with �� 1926.753(c)(5), �� 1926.757(a)(4) or �� 1926.757(e)(4), a site-specific erection plan was not developed by a qualified person and was not available at the work site. Guidelines for establishing a site-specific erection plan are contained in Appendix A to this subpart.    At the site, on or about June 22, 2013, and in times priorto and thereafter, a specific erection plan for the methods and sequences used was not provided, exposing employees to the hazards of being struck by structural steel. 29 CFR 1926.760(d)(1): Guardrail systems, safety net systems, personal fall arrest systems, positioning device systems and their components did not conform to the criteria in �� 1926.502 (see Appendix G to this subpart).    a) On or about June 22, 2013, snap hook, EN 362 2004/T Patented 0120 CE, had a defective safety interlock.  The hook was located on a safety harness worn by iron workers bolting purlins on top of a rafter over 24 feet of elevation in Building 6, exposing employees to the hazards of falls.    b) On or about June 22, 2013, and in times prior thererto, wire rope clips used for rigging the lifelines were not of the drop-forged type but were malleable cast iron, subject to breakage under load, exposing employees to the hazards of falls.
