Located at Pinnacle Metal Products, employees were required to operate an Atlantic 250 ton press brake, model number HDE250X12, serial number 57624, which had a job-made die that was used to bend up to 5/8 inch diameter metal round stock in order to fabricate brackets for staircases. The employees were at risk of a struck-by hazard from the job-made die, due to the maximum load rating not being known to ensure that the job-made press die components and welds were not overloaded.

The employer shall establish a program consisting of energy control procedures, employee training and periodic inspections to ensure that before any employee performs any servicing or maintenance on a machine or equipment where the unexpected energizing, startup or release of stored energy could occur and cause injury, the machine or equipment shall be isolated from the energy source and rendered inoperative. a. Located at Pinnacle Metal Products, there were employees removing the upper and lower dies on a 250 ton Atlantic hydraulic press brake, model number HDE250X12, serial number 57624, without utilizing energy control procedures in order to ensure that all energy located in the equipment was isolated, thereby exposing the employees to the hazards associated with the release of stored energy from a press brake. b. Located at Pinnacle Metal Products, there were employees changing the Scotchman cut-off wheel on a cold cut chop saw, model number CPO-275, serial number 30440103, without utilizing energy control procedures in order to ensure that all energy located in the equipment was isolated, thereby exposing the employees to the hazards associated with the release of stored energy from a cold cut chop saw.

Located in the fabrication shop, employees were required service equipment that needed to be locked out and tagged out in order to perform servicing to the equipment. Guards shall be affixed to the machine where possible and secured elsewhere if for any reason attachment to the machine is not possible. The guard shall be such that it does not offer an accident hazard in itself. a. Located in the fabrication shop, employees were required to operate a Van Dorn 10 inch ball bearing abrasive wheel pedestal grinder, serial number 194105, that had wing nuts used as fasteners to secure guarding of an Z36 grit abrasive belt, which could be removed by hand, thereby exposing the employees to the ingoing nip points of the drive wheels and its abrasive belt. b. Located in the fabrication shop, employees were required to operate a Do-All horizontal band saw, model number C-916M, serial number 470-90881, that had #9 tie-wire used to secure guarding of the drive wheels for where the band saw blade rotated, thereby exposing the employee to the ingoing nip point of the wheels and/or the saw's blade. c. Located in the fabrication shop, employees were required to operate a Whitney 700 series c-frame 90 ton portable hydraulic punch press that had a plexiglass guard that was not affixed and could be removed by sliding the plexiglass out by hand thereby, exposing the employees to the point of operation or from flying metal material.

The guarding device shall be in conformity with any appropriate standards therefor, or, in the absence of applicable specific standards, shall be so designed and constructed as to prevent the operator from having any part of his body in the danger zone during the operating cycle. a. Located in the fabrication shop, employees were required to operate a Do-All horizontal band saw, model number C-916M, serial number 470-90881 to cut metal material without having the unused portion of the blade guarded, thereby exposing the employees to the point of operation. b. Located in the fabrication shop, employees were required to operate a Scotchman cold cut chop saw, model number CPO-275, serial number 30440103, in order to cut metal material. The cold cut saw's guard had a hinged bracket that was tack welded which prevented the guard from covering saw's blade, thereby exposing the employees to an amputation hazard. c. Located in the fabrication shop, employees were required to operate a 250 ton Atlantic press brake, model number HDE250x12, serial number 57624, in order to bend metal material without a safe means to prevent the employees from coming into contact with the point of operation, thereby exposing the employees to a struck-by, caught-between, and/or an amputation hazard.

29 CFR 1910.215(a)(4): Work rests. On offhand grinding machines, work rests shall be used to support the work. They shall be of rigid construction and designed to be adjustable to compensate for wheel wear. Work rests shall be kept adjusted closely to the wheel with a maximum opening of one-eighth inch to prevent the work from being jammed between the wheel and the rest, which may cause wheel breakage. The work rest shall be securely clamped after each adjustment. The adjustment shall not be made with the wheel in motion. a. 29 CFR 1910.215(b)(9): Exposure adjustment. Safety guards of the types described in Subparagraphs (3) and (4) of this paragraph, where the operator stands in front of the opening, shall be constructed so that the peripheral protecting member can be adjusted to the constantly decreasing diameter of the wheel. The maximum angular exposure above the horizontal plane of the wheel spindle as specified in paragraphs (b)(3) and (4) of this section shall never be exceeded, and the distance between the wheel periphery and the adjustable tongue or the end of the peripheral member at the top shall never exceed one-fourth inch. (See Figures O-18, O-19, O-20, O-21, O-22, and O-23.) a.
